These terms cover the corporate website. Software subscriptions and custom development projects are governed by their own agreements.
1. About this website
These Terms of Service apply to the corporate website operated by Sparkle Express LLC, a Wyoming limited liability company (“Sparkle Express,” “we,” “us,” or “our”). They cover browsing its content and using its informational tools. By using the website, you agree to these Terms. If you do not agree, please stop using it.
The website introduces our software development portfolio, SaaS products, and custom development services. It does not provide customer account registration, accept payments, or complete purchases. Browsing, following a link, or creating a project brief does not place an order, start a subscription, or require either party to begin work.
2. Products and client projects
Software products may have their own terms, privacy notices, subscription conditions, and support arrangements. Those documents govern use of the relevant product. A portfolio entry describes development work; it does not by itself establish ownership, licensing rights, or availability for purchase.
Custom development requires a separate written agreement, such as a signed services agreement or statement of work. It will establish scope, deliverables, fees, payment terms, timing, responsibilities, and ownership or licensing arrangements. Website descriptions do not themselves create a binding quotation or promise a particular result.
Products marked “In progress” remain under development; their features and availability may change. A separate agreement controls any conflict with these Terms on a matter covered by that agreement.
3. Acceptable use
You may use the website lawfully to learn about our business and evaluate our work. You must not interfere with its operation, introduce malicious code, attempt unauthorized access, bypass security controls, impersonate another person, or infringe someone else’s rights.
You must not use automated requests in a way that materially disrupts the website or prevents others from using it. We may restrict access when reasonably necessary to address misuse, protect visitors or systems, or comply with law.
4. Content and intellectual property
Website text, designs, graphics, logos, code, and other materials belong to Sparkle Express or their respective rights holders and are protected by applicable law. Third-party names and trademarks remain the property of their owners.
You may view the website and save or share reasonable excerpts to evaluate our business, retaining relevant ownership notices and avoiding misrepresentation. Other copying, redistribution, or commercial reuse requires the relevant owner’s permission unless applicable law allows it.
These Terms do not transfer ownership of software, source code, frameworks, or development deliverables. Rights in custom work are determined by the applicable written project agreement. Display in our portfolio does not grant permission to reuse a product or imply exclusive ownership by Sparkle Express.
5. Project brief builder
The brief builder prepares text locally in your browser. Copy and download functions let you keep a copy for your own use. The tool does not transmit your entries to us, submit a project request, or create a client relationship.
You are responsible for the information you enter and for reviewing the resulting brief before sharing it. You retain any rights you have in your original information; using the tool does not give us ownership of it. Avoid entering passwords, payment details, or information you are not authorized to use.
6. Other websites
Links may lead to product websites or third-party resources with separate terms and privacy notices. A third-party link does not by itself mean we endorse the organization or guarantee its content. We do not control third-party websites or guarantee their continuing availability.
7. Availability and information
We aim to keep information useful and current, but it may contain errors or become outdated. We may change website content, features, or availability as our business develops.
The website and its informational tools are provided “as is” and “as available.” To the extent permitted by law, we do not guarantee uninterrupted access, error-free operation, or suitability for every visitor’s particular needs. This does not replace any express commitment in a separate product or services agreement.
8. Liability and your rights
To the extent permitted by applicable law, Sparkle Express is not liable for indirect or consequential losses arising from use of, or inability to use, this corporate website, including lost profits or business opportunities.
Nothing in these Terms excludes liability that cannot legally be excluded, limits mandatory consumer rights, or changes liability agreed in a separate written contract.
9. Changes and governing law
We may update these Terms by posting a revised version and changing the date above. Changes apply prospectively to website use after they take effect.
Wyoming law governs these Terms, subject to mandatory legal protections that apply where you live. If a provision is unenforceable, the remaining provisions continue to apply.
